The applicant typically has 3 months from the date of the examination report to respond to objections. This period may be extended by 1 month upon request and payment of extension fees. Failure to respond results in the application being deemed abandoned.

The reply should address each objection point-by-point, provide arguments and evidence supporting novelty and originality, amend representations if required, clarify classification, and request a hearing if necessary. A well-structured response increases chances of overcoming objections.

Yes, if the objection relates to the quality or clarity of representations, amended or additional views can be submitted. However, the amended representations must not introduce new matter or substantially alter the design from what was originally filed.

If the reply is not accepted, the applicant may request a hearing before the Controller of Designs. If the hearing also does not resolve the objections, the application is refused. The applicant can appeal the refusal to the High Court within the prescribed period.
