Overview of FSSAI Annual Return

FSSAI Annual Return (Form D-1) is mandatory for all food business operators holding central licenses and certain state license categories. Due by May 31st annually, the return reports the quantity of food products manufactured, imported, or exported during the financial year, along with details of production units, turnover, and compliance status. Importers file a separate return (Form D-2).

The return requires disclosure of food categories handled, quantities in MT/KL, value of production, imports/exports, and details of quality control measures. Manufacturers must report production quantities by food category as per FSSAI classifications. The return helps FSSAI monitor food production volumes, track imports for safety surveillance, and plan regulatory resources.

Non-filing attracts penalties and may affect license renewal. Returns must be filed even if there was no production or import during the year (NIL returns). The data is used for national food safety planning and risk assessment. Large food businesses must ensure accurate reporting as discrepancies can trigger inspections and enforcement actions.

FSSAI return filing is the periodic reporting requirement for Food Business Operators to report details of their food business activities, including quantity of food handled, processed, imported, or exported. However, currently, FSSAI has temporarily suspended the mandatory return filing requirement for most FBOs.

Previously, all food business operators holding FSSAI licenses (manufacturers, importers, exporters) were required to file periodic returns. The requirement has been temporarily relaxed, and FBOs are only required to maintain records internally for inspection when required.

Form D-1 was the annual return filed by FBOs by May 31 each year. Form D-2 was the half-yearly return filed by importers. These forms reported quantities of food products manufactured, imported, or exported during the period.

Currently, FSSAI has not mandated any periodic return filing for most FBOs. However, FBOs must maintain proper records of production, sales, imports, and exports as per FSS Act requirements and produce them during inspections by food safety officers.

FBOs must maintain records of raw material sourcing, production quantities, batch details, sales records, quality control reports, recall procedures, and complaint registers. These records must be maintained for the period specified in the FSS Act and regulations.

FSSAI may reintroduce return filing in a simplified manner through the FoSCoS portal. FBOs should regularly check FSSAI notifications for any updates on the return filing requirements and comply promptly if reintroduced.

FSSAI return was a periodic reporting of business activities (quantities handled). FSSAI renewal is the extension of the license/registration validity period. Returns are about operational data, while renewal is about continuing the authorization to operate.

If return filing is reintroduced, FBOs must file returns within the specified timelines. Non-filing would attract penalties under the FSS Act. FBOs should maintain records regularly to ensure they can file accurate returns if required.

Importers were previously required to file half-yearly returns (Form D-2). Currently, this requirement is also suspended. However, importers must comply with customs documentation and FSSAI clearance requirements for each import consignment.

FBOs should regularly visit the FSSAI website (fssai.gov.in), check the FoSCoS portal notifications, subscribe to FSSAI newsletters, and follow official communications from the Food Safety Department to stay informed about any changes in return filing requirements.
